La loi du 26 juin 1990 (mesure de protection des malades mentaux) a remplacé l’ancienne loi de collocation de 1850. Conçue dans la lignée des principes de la Convention européenne des droits de l’homme, elle constitue une réforme importante du traitement involontaire des malades mentaux et rappelle, sans nul doute, que le malade est sujet de droit. L’article décrit le champ d’application de la loi du 26 juin 1990 et les modalités d’initiation d’une mesure de protection. Ensuite, sont abordées dans leurs décours la mesure en milieu hospitalier (procédure ordinaire et procédure urgente) ainsi que la mesure en milieu familial. Cet article se veut également critique par rapport à certaines modalités d’application de cette loi du point de vue du médecin et reflète de manière objective le dialogue souvent complexe entre deux mondes que tout sépare : la médecine et le droit. The law of June 26, 1990 (protection measure of the mental patients) has replaced the old law of collocation of 1850 (review in 1873). Conceived in the line of the principles of the European Convention of the Humans right, it constitutes an important reform of the involuntary treatment of the mental patients and recalls, without any doubt, that the patient is prone of right. The article describes the scope of application of the law of June 26, 1990, and the methods of initiation of a protection measure. Then, the measure in a hospital environment (ordinary procedure and urgent procedure), as well as the measure in a family environment are approached in their waning. Furthermore, the author discusses the networks between physicians and lawyers and the difficulty to communicate between these two worlds, such as Justice and Medicine. Rev Med Brux 2013 ; 34 : 380-7
